Nuestros términos y condiciones

These Terms of Service (the “Terms”) govern your use of the website operated by RSKC LLC(“Rent Something KC,” “we,” “us,” or “our”) and any equipment-rental and related services we provide in the Kansas City metro area. By using our website or renting equipment from us, you agree to these Terms. If you do not agree, please do not use our services.

1. Eligibility

You must be at least 18 years old, a U.S. resident, and legally able to enter into a binding contract to rent from us. By creating an account or placing an order, you confirm that the information you provide is accurate and that you meet these requirements. We may require a valid government-issued ID before completing a rental.

2. Account registration

Some features require an account. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us promptly at the contact address below if you suspect unauthorized access. We may suspend or close an account that we believe is being misused.

3. Rentals, scheduling, and delivery

When you place a rental order, we will confirm the equipment, the rental term, the delivery window, the service address, and the price. Delivery and pickup are scheduled in our service area and may be rescheduled if weather, road conditions, access issues, or staffing make a scheduled window impractical. You agree to be available to receive delivery at the agreed window and to provide safe and lawful access to the service address.

Equipment remains the property of Rent Something KC for the duration of the rental. Title does not transfer to you under any circumstance.

4. Payments, deposits, and auto-pay

Rental fees, deposits, taxes, delivery charges, and any other amounts are disclosed before you confirm an order and are charged to the payment method you authorize through Stripe. By placing a rental order, you authorize us (and our payment processor) to charge that payment method on a recurring basis for the rental term, including any renewal periods, fees for damage or loss, late fees, and other amounts owed under these Terms.

If a charge fails, we may retry the payment, contact you for an updated payment method, and pause or pick up equipment until the balance is current. Repeated failed payments may result in additional fees and termination of the rental.

5. Care of equipment

While the equipment is in your possession you agree to:

  • Use the equipment only for its intended purpose and in accordance with the manufacturer’s instructions and any guidance we provide;
  • Not modify, repair, paint, alter, sell, sublet, or transfer the equipment;
  • Keep the equipment in a safe, indoor, climate-appropriate location and protect it from theft, fire, water, and weather damage;
  • Allow us reasonable access to inspect, service, or recover the equipment.

6. Damage, loss, and theft

You are responsible for the equipment from the time of delivery until pickup is complete. If the equipment is damaged beyond ordinary wear and tear, lost, stolen, or otherwise rendered unusable, you agree to pay the cost of repair or, if not repairable, replacement, plus any related fees disclosed at the time of rental. We will document the condition and the charges and contact you before applying non-routine charges where reasonably possible.

7. Term, renewal, and cancellation

Rentals continue for the agreed term and then renew automatically for additional periods unless you cancel. You may cancel a rental at any time by contacting us; the cancellation takes effect at the end of the current billing period, after which we will schedule pickup. Cancellation does not refund amounts already charged for periods you kept the equipment.

8. Pickup and return

At the end of the rental we will schedule pickup at the service address. You agree to make the equipment available in the same location it was delivered, ready for removal, and to provide safe and lawful access. If we are unable to pick up the equipment as scheduled because of conditions in your control, additional pickup-attempt fees may apply, and the rental continues to accrue until the equipment is recovered.

9. Prohibited use

You agree not to:

  • Use the equipment for any illegal purpose or in violation of any local, state, or federal law or regulation;
  • Move the equipment outside of the Kansas City metro area without our written consent;
  • Interfere with the equipment’s safety, monitoring, or smart features;
  • Use the website or services in a way that disrupts our systems, attempts to gain unauthorized access, or circumvents security.

10. Communications and SMS

By providing your phone number you consent to receive calls and text messages from Rent Something KC related to your rental, including confirmations, delivery and pickup updates, service reminders, billing notices, and service-related questions. Calls may be recorded. Message and data rates may apply. You can opt out of non-essential messages by replying STOP; opting out does not stop transactional messages required to complete an active rental.

11. Disclaimers

The website and services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, except those that cannot lawfully be disclaimed. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components, or that any specific equipment will be available at the time of order.

12. Limitation of liability

To the maximum extent permitted by law, RSKC LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of the website, the services, or any equipment, whether based in contract, tort, or any other theory. Our total liability for any claim arising under these Terms is limited to the amount you paid us for the rental giving rise to the claim in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless RSKC LLCand its officers, employees, and agents from any claim, loss, damage, liability, or expense (including reasonable attorneys’ fees) arising from your use of the equipment, your breach of these Terms, or your violation of any law or the rights of a third party.

14. Governing law and venue

These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-laws principles. You and RSKC LLC agree that any dispute arising out of or relating to these Terms or the services will be resolved exclusively in the state or federal courts located in Johnson County, Kansas, and you consent to the personal jurisdiction of those courts.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Effective Date” above and, for material changes, provide additional notice (for example, by email or a notice on the site). Your continued use of the website or services after a change takes effect means you accept the updated Terms.

16. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy and any rental-order document we share with you, are the entire agreement between you and RSKC LLC regarding the services and supersede any prior agreements on the same subject.
