Rental Agreement

Our appliance rental agreement

This Appliance Rental Agreement ("Agreement") is between Rent Something KC ("Company") and the customer ("Customer") for the rental of the appliance(s) listed in the delivery record.

1. Appliance Information

This Agreement applies to the appliance(s) listed on the attached or separately provided Delivery and Condition Record (the "Delivery Record"), which is incorporated herein by reference. The appliance is rented as-is, in good working order (including brand, model, and serial number), which will be confirmed at delivery.

2. Rental Term

The rental is month-to-month unless otherwise stated. Payments are due the same day each month, starting from the delivery date. Customers must provide at least seven (7) days written notice prior to the end of the current monthly term to cancel and schedule the return of the appliance. Monthly payments are not prorated for partial months.

3. Payment & Fees

The Customer agrees to pay the monthly rental fee as specified. If any payment is not received by the Company within five (5) calendar days following the due date, the Customer shall be charged a late fee of fifteen dollars ($15). If payment is not received within 14 days of the due date, we will immediately collect our units and cancel the rental agreement. Upon termination of this Agreement for failure to pay, the Customer grants Rent Something KC the immediate right to enter the premises where the Appliance is located to repossess and retrieve the equipment without further notice or legal process. Repairs for damage caused by misuse or neglect will incur a non-refundable $125 Service Visit Fee, plus the cost of all necessary parts and labor required to complete the repair. If the appliance is deemed a total loss (cannot be repaired), or is lost or stolen, the Customer is responsible for a Replacement Fee not to exceed Four Hundred Dollars ($400) per appliance. Customer agrees to pay all costs incurred by Rent Something KC to collect past-due payments or to recover the appliance, including reasonable attorney’s fees, collection agency fees, and court costs.

4. Delivery & Installation

Delivery and installation are included at no additional cost unless otherwise stated. Customer acknowledges that Rent Something KC personnel are not licensed plumbers or electricians and Rent Something KC is not responsible for any pre-existing or latent conditions in the Customer’s utility hookups. Rent Something KC is not liable for property damage arising from or during the installation process.

5. Service & Repairs

We provide all service and repairs for normal wear and tear at no cost to the Customer. Service will be scheduled on a priority basis, typically within 72 hours of a reported issue. The appliance may not be altered, repaired, or modified by the Customer or a third party without written approval from Rent Something KC.

6. Customer Responsibilities

Use the appliance according to the manufacturer’s guidelines. Keep the appliance clean and in good condition. Do not move, resell, sublease, or modify the appliance without written consent. Transfers of this Agreement to a new party residing at the same location are permitted only under the conditions outlined in Section 13. The Customer is responsible for and agrees to obtain and maintain renter’s insurance (or comparable coverage) sufficient to cover potential damage, theft, or loss of the Appliance, as well as any liability arising from its use. If the appliance requires excessive cleaning upon return, the Customer may be charged a cleaning fee of up to one hundred and fifty dollars ($150).

7. Company Ownership

All rented appliances remain the property of Rent Something KC at all times. This is strictly a rental agreement and is not a rent-to-own contract. Customers do not gain any ownership rights regardless of rental duration.

8. Access for Repairs or Pickup

The Customer agrees to allow reasonable access to the appliance for service, repair, inspection, or pickup. If Customer fails to allow access for pickup within seven (7) days following termination or cancellation, Rent Something KC reserves the right to charge the Customer for the full monthly rental rate until the appliance is recovered.

9. Utility Connections

The Customer is responsible for maintaining all utility connections (electricity, water, gas) required for proper operation of the appliance.

10. Early Termination by Company

Rent Something KC reserves the right to end the rental and retrieve the appliance if payments are not made, if the Agreement terms are violated, or for any other reason deemed necessary by Rent Something KC.

11. Liability Waiver

Rent Something KC assumes no liability under any circumstances. Rent Something KC is not responsible for — and expressly disclaims any responsibility for — all damages of any kind. This includes (but is not limited to) property damage, loss of use, loss of income, personal injury, fire, water damage, electrical issues, or any other harm that may occur. The Company’s maximum liability under this Agreement is strictly limited to the total rental fees paid by the Customer for the specific appliance in the month the damage occurred.

12. Indemnification

The Customer shall indemnify, defend, and hold harmless Rent Something KC, its agents, and employees from and against any and all claims, actions, suits, proceedings, costs, expenses, damages, and liabilities, including attorney’s fees, arising out of, connected with, or resulting from the Customer’s possession, use, or misuse of the Appliance, or any breach of this Agreement.

13. Transfer of Agreement and Customer Liability

• Request for Transfer: The Customer may request to transfer all rights and responsibilities under this Agreement to a new party (the "New Customer") residing at the same location. • Notice Requirement: The Customer must notify Rent Something KC in writing of the intent to transfer at least fourteen (14) days prior to the requested transfer date. • Approval Process: Any requested transfer is subject to the review and express written approval of Rent Something KC in its sole discretion. • Execution of New Agreement: The transfer is only complete and legally binding once the New Customer has executed a new Appliance Rental Agreement with Rent Something KC. • Release of Liability: The original Customer shall remain fully and jointly liable for all obligations until such time as the New Customer’s agreement is fully executed, and the original Customer receives a written release of liability from Rent Something KC. • Fees: Rent Something KC reserves the right to charge a non-refundable administrative transfer fee.

14. Acknowledgement & Digital Signature
